These Terms of Service (“Terms”) govern your use of the mowfix.net website and the services provided by Mow & Fix Property Maintenance. By using our website or purchasing services from us, you agree to these Terms.

These Terms are split into two parts:

  • Part A: Website Terms — covers your use of our website.

  • Part B: Service Agreement — governs services you purchase from us.

Part A: Website Terms

1. Use of the website

You may use our website for lawful purposes only. You agree not to:

  • Copy, scrape, or republish content without permission

  • Attempt to gain unauthorised access to our systems

  • Use the site to transmit malicious code or spam

  • Impersonate any person or entity

2. Intellectual property

All content on mowfix.net, including text, graphics, logos, photos, and code, is the property of Mow & Fix Property Maintenance or our licensors and is protected by copyright and trademark law. You may not reproduce it without permission.

3. Disclaimer

The website is provided “as is” without warranties of any kind. We do our best to keep information accurate and up to date, but we do not warrant that the site will be error-free or uninterrupted.

4. Links to other sites

Our site may link to third-party websites. We are not responsible for their content or practices.

Part B: Service Agreement

This Service Agreement is made between SASSOM PTY LTD, The Trustee for the SASSOM Business Trust, T/A Mow & Fix Property Maintenance (“Contractor”) and you (“Client”) when you purchase services from us. By accepting a quote or making a payment, you agree to these terms.

5. Services and authorisation

Mow & Fix Property Maintenance agrees to furnish labor and materials for the services you purchase at the property address you provide. You the Client represent and warrant that you have the authority to grant us the right to perform services at that property. The specific methods and materials used will be determined by the Contractor.

You agree to notify us in writing if ownership of the property changes. Active subscriptions may be transferred to a new owner at the same property if both parties agree.

6. Service term

  • Recurring Lawn Mowing & Gardening Packages:

    • Are serviced weekly or fortnightly (clients choice) September 1st through May 31st.

    • Are serviced every 4-weeks June 1st through August 31st.

    • A scheduled service can be skipped at the customers request, (minimum 24-business hours notice is required), the Contractor reserves the right to change an Over Grown Fee (+50%) if the grass is too long or too thick on the next scheduled service.

    • If access to the property is not possible on the scheduled day of service, the full service fee will be charged.

    • The Contractor may need to change the day of service due to weather or for some other unexpected event, the contractor will re-schedule the service at the earliest convenance.

    • A deposit (non-refundable) equal to the first service charge is payable before any services will commence, the deposit will be used toward payment for the final service.

    • The recurring service agreement can be canceled at any time with 1-weeks written notice, sent by email to admin@mowfix.net

  • One Off Jobs:

    • One off jobs are bound by the written quote, any changes must be in writing.

    • A 50% (non-refundable) deposit is required before any work commences.

7. Auto-renewal

For continuity of service,  Recurring Lawn Mowing & Gardening Packages automatically renew for the next service at the end of each service. To cancel or change your package, you must notify us in writing at least 1-week before the next service date, by email admin@mowfix.net. All other terms remain in effect during any renewal period.

8. Payments

General payment terms:

  • We accept Credit Card Payments Master & Visa.

  • A deposit is required before any work will commence.

  • Final Payment is due on receipt of invoice.

  • We may suspend services at our sole discretion when a payment is past due. We are not liable for any costs or damages resulting from a suspension for non-payment.

  • If collection action becomes necessary, you agree to pay all reasonable collection costs, including legal fees, court costs, and arbitration costs.

9. Overgrowth surcharges

When you request lawn care, we assume grass is under 15cm tall unless you tell us otherwise. Lawns over 15cm are considered overgrown. By ordering service, you agree to any applicable overgrown surcharges needed to safely bring your lawn back to manageable height. We will always provide photo documentation of overgrown charges.

Tiers:

  • 15-30cm: +50% of the standard mowing price

  • 31-40cm: +100% of the standard mowing price

  • 40cm or taller: Requires a custom quote

10. Damages and liability

The contractor is not responsible for damage caused by events outside our control, natural causes, acts of God, drought, or unusually dry or wet weather.

We are also not responsible for damage to sub-surface items, including but not limited to pet fences, cable TV, security lines, irrigation, lighting, gas or pool equipment lines, or any items under the top of grass height.

We are also not responsible for damage caused to property by sub-surface items that come in contact with our equipment, including but not limited to stones, rocks, pavers, bricks, toys or any item under the top of grass height.

If we directly damage your property through our work (outside the exclusions above), we will repair, replace, or reimburse the reasonable replacement cost. You must provide written notice of any damage within 7 days of it occurring.

We are not liable, under any circumstances, for incidental, consequential, special, expectation, punitive, or exemplary damages.

11. Governing law

These Terms are governed by the laws of the State of Queensland. Any dispute arising from these Terms or our services will be resolved in the state or federal courts located in Queensland.

12. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top will reflect the most recent version. Continued use of our website or services after changes means you accept the revised Terms.
